1.1. These General Terms and Conditions (hereinafter referred to as "GTC") of "Dr. Frederik Franke" (hereinafter referred to as "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter referred to as "Customer") and the Seller regarding the goods offered by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby objected to unless otherwise agreed.
1.2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1.3. An entrepreneur is a natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its commercial or self-employed professional activity.
2.1. The presentation of goods, particularly in the online shop, does not constitute a binding offer by the Seller.
2.2. The Customer first places the selected goods in the shopping cart. The ordering process follows, during which all necessary data for order processing are collected. At the end of the ordering process, a summary of the order and contract data appears. By confirming this data and clicking the final order button, the Customer submits a binding offer to purchase the goods in the shopping cart.
The Customer may also submit this offer via fax, email, postal mail, or telephone.
2.3. The Seller accepts the Customer's offer through one of the following alternatives:
The contract is deemed concluded at the moment the first of these alternatives occurs.
The acceptance period begins on the day following the Customer’s submission of the offer and ends at the end of the fifth day after submission. If the Seller does not accept the offer within this period, the offer is deemed rejected, and the Customer is no longer bound by their declaration of intent.
2.4. If the Customer selects "PayPal" or "PayPal Express" as the payment method, they submit their offer by clicking the final order button. If the Customer simultaneously authorizes PayPal to process the payment by clicking this button, the Seller accepts the Customer’s offer at the moment the payment order is issued.
2.5. The Seller stores the contract text of the contract concluded with the Customer. The contract text is stored in the Seller’s internal systems. The Customer can access the GTC at any time on this page. The order details, withdrawal instructions, and GTC will be sent to the Customer via email. After completing the order, the Customer can access the contract text via their customer login if they have created an account.
2.6. Before clicking the order button, all entered information is displayed and can be reviewed and corrected using the back button of the browser or standard mouse and keyboard functions. Additionally, correction buttons may be available, labeled accordingly.
2.7. The contract language is German.
2.8. It is the Customer's responsibility to provide a correct email address for order processing and to ensure that emails related to the order are not blocked by spam filters.
3.1. If the Customer is a consumer, they generally have a right of withdrawal.
3.2. The Seller's withdrawal policy applies to the right of withdrawal.
3.3. Consumers who, at the time of contract conclusion, are not residents of an EU member state and whose sole residence and delivery address are outside the EU do not have a right of withdrawal.
4.1. The displayed prices are final prices and include the legally required VAT. Any additional shipping costs are specified in the product description.
4.2. For deliveries outside the EU, additional customs duties, taxes, or fees may apply, which the Customer must pay directly to the relevant customs or tax authorities or financial institutions. Customers are advised to check with the appropriate authorities before ordering.
4.3. The available payment methods are those listed in the online shop.
4.4. If payment is made in advance via bank transfer, the payment is due immediately after contract conclusion unless otherwise agreed.
4.5. Payments via "PayPal" or "PayPal Express" are processed through PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to PayPal’s terms of use, available at:

5.1. Goods are shipped to the delivery address specified by the Customer. If payment is made via "PayPal" or "PayPal Express," the delivery address stored with PayPal at the time of payment is used.
5.2. If the Seller incurs additional costs due to an incorrect delivery address, an incorrect recipient, or other circumstances preventing delivery, the Customer must reimburse these costs unless they are not at fault. This does not apply to shipping costs if the Customer has exercised their right of withdrawal.
5.3. If self-collection is agreed upon, the Customer will be informed when their order is ready for pick up. They can then collect the goods at the Seller’s location or an agreed pick up point without incurring shipping costs.
If the Seller provides goods in advance, ownership remains with the Seller until the purchase price is fully paid.
7.1. The statutory liability for defects applies unless otherwise stated in these GTC.
7.2. Customers are encouraged to report obvious transport damage to the carrier and notify the Seller. Failure to do so does not affect the Customer's legal or contractual warranty claims.
If the Seller is contractually obligated to process goods according to Customer specifications, the Customer must ensure that no third-party rights are violated. The Customer agrees to indemnify the Seller from any third-party claims in this context, including reasonable legal defense costs. The Customer must provide all necessary information truthfully and promptly if claims are made by third parties.
9.1. The law of the Federal Republic of Germany applies, excluding international sales law. However, mandatory consumer protection regulations in the Customer’s country of residence remain unaffected.
9.2. This legal choice does not apply to the statutory right of withdrawal for consumers outside the EU.
